INFORMED CONSENT FOR INTERNATIONAL ONLINE MEDIATION

CONSENTIMIENTO INFORMADO DE MEDIACIÓN INTERNACIONAL ONLINE

1. Nature of the Service / Naturaleza del servicio

• English: The service provided by María José Bonilla consists exclusively of a private, voluntary, and ONLINE-ONLY mediation process aimed at facilitating communication. The mediator: (a) Does NOT act as a lawyer; (b) Does NOT provide legal advice; (c) Does NOT make binding decisions; (d) Does NOT issue sentences or awards.
• Español: El servicio prestado por María José Bonilla consiste exclusivamente en un proceso de mediación privada, voluntaria y exclusivamente ONLINE, cuyo objetivo es facilitar la comunicación. La mediadora: (a) NO actúa como abogada; (b) NO proporciona asesoramiento legal; (c) NO toma decisiones vinculantes; (d) NO dicta sentencias ni laudos.

2. Legal Representation and MOU / Representación legal y MOU

• English: The parties acknowledge that any legal advice must be provided by their own independent legal counsel. Any resulting agreement or Memorandum of Understanding (MOU) must be reviewed and filed with the Court by the parties’ respective lawyers for its legal validation.
• Español: Las partes reconocen que cualquier asesoramiento legal debe ser proporcionado por su propio abogado independiente. Cualquier acuerdo resultante o Memorándum de Entendimiento (MOU) debe ser revisado y presentado ante el Juzgado por los respectivos abogados de las partes para su validación legal.

3. Online Format and Tech Risks / Modalidad online y riesgos técnicos

• English: Mediation will be conducted via videoconference. Parties accept the technological risks inherent to online communication, including potential connectivity issues or platform security.
• Español: La mediación se realizará mediante videoconferencia. Las partes aceptan los riesgos tecnológicos inherentes a la comunicación online, incluyendo posibles problemas de conectividad o seguridad de las plataformas.

4. Jurisdiction and Applicable Law / Jurisdicción y ley aplicable

• English: This service is provided from Spain and is governed exclusively by Spanish law. Any dispute arising between the signing party (client) and the mediator (María José Bonilla) regarding this professional service shall be submitted exclusively to the jurisdiction of the Spanish courts.
• Español: Este servicio se presta desde España y se rige exclusivamente por la legislación española. Cualquier controversia o reclamación que surja entre la parte firmante (cliente) y la mediadora (María José Bonilla) en relación con este servicio profesional, se someterá exclusivamente a la jurisdicción de los tribunales de España.

5. LIMITATION OF LIABILITY / LIMITACIÓN DE RESPONSABILIDAD

• English: The mediator’s liability for any professional error, omission, or dispute arising from the service provided shall be strictly limited to the total amount paid by the client for the specific mediation session or service in question. By engaging this service, the client expressly waives the right to claim any amount exceeding said fee.
• Español: La responsabilidad civil de la mediadora por cualquier error, omisión o conflicto derivado del servicio prestado se limitará estrictamente al importe total abonado por el cliente por la sesión de mediación o servicio específico en cuestión. Al contratar este servicio, el cliente renuncia expresamente a reclamar cualquier cantidad que supere dichos honorarios.

6. Confidentiality / Confidencialidad

• English: The process is strictly confidential. Information shared during sessions cannot be used in court proceedings or disclosed without mutual consent, except where legally required.
• Español: El proceso es estrictamente confidencial. La información compartida no podrá ser utilizada en procedimientos judiciales ni divulgada sin consentimiento mutuo, salvo obligación legal.

7. Cancellation Policy / Política de cancelación

• English: Cancellations or rescheduling require at least 48 hours’ notice. Cancellations or no-shows with less than 48 hours’ notice are non-refundable.
• Español: Los cambios o cancelaciones requieren un preaviso mínimo de 48 horas. Las cancelaciones o ausencias con menos de 48 horas de antelación no serán reembolsables.

8. Fees / Honorarios

• English: The parties agree to the professional fees previously established for mediation sessions and agreement drafting.
• Español: Las partes aceptan los honorarios profesionales previamente establecidos para las sesiones de mediación y la redacción de acuerdos.
